How can migrant industry leaders benefit from the UK Global Talent visa?

The UK Global Talent visa category (formerly Tier 1 (Exceptional Talent)) offers lots of flexibility to recognised or promising migrant leaders, allowing them to work in the country and sometimes providing a fast-track option to settlement.

We explore the 2-part application process and some of the benefits of this route over other UK visa categories.

Part 1 – Relevant endorsement or qualifying award

Unlike some of the UK visa categories (such as the former Tier 2 (General)/ current Skilled Worker route), there is no requirement to obtain a “Certificate of Sponsorship” to apply for the UK Global Talent visa. However, visa applicants will need to be endorsed as a leader or potential leader in the broad field of:

• Academia or research;
• Arts and culture; or
• Digital technology

Each broad field is further divided into specialist areas, and this then determines which endorsing body considers whether you are a recognised leader or rising star in the field.

For example, individuals working in the space sector would usually be considered under the broad field of “Academia or research”,  under the specialist area of “Aerospace”, and therefore seek endorsement from The Royal Academy of Engineering. The endorsement process is effectively seeking recognition through assessment of being an exceptional leader or promising leader,

Alternatively, recipients with a recognised award could qualify for a UK Global Talent visa, without the need for endorsement.

For example, under the “Arts and culture” field, an architect could qualify by securing endorsement from The Royal Institute of British Architects or for example, having received the recognised Royal Gold Medal award.

Similarly, someone could qualify under the “Digital technology” field with endorsement from Tech Nation or for example, being awarded the Turing Award by the Association for Computing Machinery.

Part 2 – Visa application

Once an individual has secured endorsement or received a recognised award, it will be necessary to submit a UK Global Talent visa application, together with any necessary supporting documents.

Currently, the UK visa fee is £716 plus the Immigration Health Surcharge (which is charged for the length of the visa applied for).

The visa processing time will typically vary between 3 to 8 weeks depending on whether the application is submitted from within the UK, or outside the UK. There may be scope to pay a premium for a priority or super priority processing service, which can potentially get a decision by the end of the next working day.

Benefits of this visa

The UK Global Talent visa category seeks to attract the best of the best, and those who have potential to become leaders in their field. As such, there are a number of positive benefits and flexible options built into this immigration route.

For example, applicants can request a visa length between 1 and 5 years, which may potentially help save costs – most other visa categories are granted for predetermined lengths of time.

Visa holders will be able to work for businesses and/or be self-employed, including setting up their own companies – offering greater flexibility and freedom than most other UK visa categories.

In addition, depending on the circumstances, individuals may be able to apply for indefinite leave to remain in the UK (effectively permanent residence) after just 3 years or even sooner!
